TICKETING TERMS & CONDITIONS
In order for the purchaser and/or holder (hereinafter referred to as “You” or “Your”) of a valid ticket, wristband, credential, pass, or entry authorization (collectively, a “Ticket”) to enter any event produced, promoted, hosted, or operated by Nightfall Presents LLC (the “Company,” “Nightfall Presents,” “Management,” “we,” “us,” or “our”) (each, an “Event”), You must possess a valid Ticket that permits access to the Event and comply with all check-in, validation, and entry requirements.
BY PURCHASING A TICKET, ACCEPTING A TICKET, ENTERING THE EVENT PREMISES, OR REMAINING AT THE EVENT, YOU UNCONDITIONALLY AGREE TO BE BOUND BY THESE TICKETING TERMS & CONDITIONS (THIS “AGREEMENT”). IF YOU DO NOT AGREE, DO NOT PURCHASE A TICKET AND DO NOT ENTER THE EVENT.
ARTICLE 1: ACCEPTANCE / YOUR TICKET / REVOCABLE LICENSE
Unconditional Acceptance.
Your purchase, possession, or use of a Ticket and/or Your presence at the Event constitutes Your unconditional acceptance of this Agreement and all posted or communicated rules, policies, safety notices, and venue regulations (collectively, the “Policies”), which may be modified at any time without notice.Revocable License.
Your Ticket is a revocable license, not property. Management reserves the absolute right, in its sole discretion, to revoke this license, refuse admission, or remove any person at any time, with or without cause and without refund, subject only to applicable law.Ticket Validation.
You must submit Your Ticket for validation upon entry and upon request. Wristband exchanges, re-validation, or re-scanning may be required.No Cash Value / No Replacement.
Tickets have no cash value and are not redeemable for cash. Tickets or wristbands that are lost, stolen, destroyed, damaged, altered, or confiscated will not be replaced. You assume all risk of loss or theft.Unauthorized Sources / Counterfeits.
Tickets obtained from unauthorized sellers may be counterfeit and worthless. Management is not responsible for any losses incurred from unauthorized purchases.No Transfer / Anti-Sharing.
Unless expressly authorized in writing or through an approved resale platform, Tickets are non-transferable. Sharing, duplicating, copying, tampering with, or attempting to reuse a Ticket or wristband will result in immediate removal and forfeiture without refund.Event Control Rights.
For safety or operational reasons, Management may postpone, cancel, interrupt, stop, relocate, modify, evacuate (in whole or in part), restrict movement, or deny access to the Event premises at any time, even if You possess a valid Ticket.
ARTICLE 2: EVENT CHANGES / LINEUP / SCHEDULE
Changes Permitted.
Management reserves the right to change or modify any aspect of the Event at any time, including but not limited to artist lineup, set times, order of performance, duration, venue layout, capacity, production elements, or amenities.No Artist Guarantee.
Artist names on promotional materials are for informational purposes only and do not indicate billing order, headline status, or guaranteed appearance.No Refund for Changes.
Changes to lineup, schedule, production, or Event format do not entitle You to any refund, exchange, credit, or claim.
ARTICLE 3: NO REFUNDS / ALL SALES FINAL / FORCE MAJEURE
ALL SALES FINAL.
EXCEPT AS OTHERWISE REQUIRED BY LAW, ALL TICKET SALES ARE FINAL. NO REFUNDS OR EXCHANGES WILL BE ISSUED FOR ANY REASON. THE EVENT IS A RAIN OR SHINE EVENT.Denied Entry or Removal.
If You are denied entry or removed for any reason, Your Ticket is forfeited and no refund will be issued.Force Majeure.
Management shall not be liable for cancellation, delay, interruption, modification, or relocation of the Event due to events beyond its reasonable control, including but not limited to: acts of God; severe weather; fire; flood; terrorism or threat thereof; labor disputes; power failure; venue issues; government orders; public health emergencies; epidemics or pandemics (including COVID-19); capacity restrictions; civil unrest; or national emergencies (“Force Majeure Event”).Maximum Remedy.
If a refund is required by law or issued at Management’s sole discretion, Your maximum remedy shall be limited to the face value of the Ticket only, excluding all fees, taxes, service charges, and incidental expenses.
ARTICLE 4: ASSUMPTION OF RISK
Inherent Risks.
Attendance at live music events involves inherent risks of personal injury, illness, disability, death, emotional distress, and property loss.Crowd & Patron Risks.
Risks include crowd movement, moshing, pushing, jumping, dancing, falls, intoxicated patrons, fights, harassment, and the possibility that security cannot fully monitor or control all attendees.Venue & Physical Risks.
Risks include uneven surfaces, wet or slippery floors, stairs, barricades, cables, truss, lighting, sound equipment, and other production elements.Audio / Visual Risks.
Risks include extremely loud music, heavy bass frequencies, hearing damage, tinnitus, strobe lights, flashing lights, lasers, LEDs, fog, haze, smoke, and projections, which may affect individuals with epilepsy, photosensitivity, respiratory conditions, pregnancy, or other medical issues.Pyrotechnics & Special Effects.
WARNING: The Event may include pyrotechnics, flame effects, sparks, heat-based effects, fog, haze, smoke, CO₂ or cryogenic effects, confetti, and other special effects (collectively, “Special Effects”). These effects may be dangerous and may cause burns or injury.Voluntary Assumption.
By entering, You voluntarily assume all known and unknown risks, whether occurring before, during, or after the Event.
ARTICLE 5: RELEASE / WAIVER / COVENANT NOT TO SUE
To the fullest extent permitted by Ohio law, You forever release, waive, discharge, and covenant not to sue Nightfall Presents LLC, the venue, venue owners/operators, artists, performers, DJs, ticketing providers, sponsors, partners, security, contractors, vendors, and their respective owners, officers, directors, employees, agents, and affiliates (collectively, the “Company Parties”) from any and all claims, liabilities, injuries, losses, or damages of any kind arising out of or related to the Event, including claims based on negligence or the acts of third parties, except where prohibited by law.
ARTICLE 6: INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Company Parties from any claims, damages, losses, liabilities, costs, or attorney’s fees arising out of or related to Your actions, omissions, violations of this Agreement, or injury or damage caused by You.
ARTICLE 7: LIMITATION OF LIABILITY
To the fullest extent permitted by law:
The Company Parties shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.
Your sole and exclusive remedy for dissatisfaction with the Event is to leave the Event.
These limitations are an essential element of the basis of the bargain.
ARTICLE 8: ENTRY, SEARCHES & SECURITY
All persons and property are subject to search at any time. Searches may include bag checks, pat-downs, and inspection of personal items. Refusal to submit to search will result in denied entry or removal without refund. Prohibited items may be confiscated and will not be returned.
ARTICLE 9: PROHIBITED ITEMS & ILLEGAL ACTIVITY
Management may prohibit any item deemed unsafe or disruptive, including but not limited to weapons (regardless of permit), illegal substances, drug paraphernalia, fireworks, glass, lasers, drones, explosives, flammables, and professional recording equipment.
The Company maintains a zero-tolerance policy for illegal activity and underage drinking.
ARTICLE 10: CONDUCT / RIGHT TO REMOVE ANYONE
Management reserves the absolute right to refuse admission or remove any person at any time, with or without cause, including for disorderly conduct, intoxication, harassment, unsafe behavior, or failure to follow instructions. Removal results in forfeiture of the Ticket without refund. Re-entry may be prohibited.
ARTICLE 11: AGE REQUIREMENTS & IDENTIFICATION
Certain Events may require a minimum age (e.g., 18+ or 21+). Valid government-issued photo identification must be presented upon request. Failure to present valid ID may result in denied entry or removal without refund.
ARTICLE 12: RECORDING / LIKENESS RELEASE / SURVEILLANCE
By attending, You grant the Company Parties the irrevocable right to capture and use Your name, image, likeness, voice, and appearance in any media worldwide, in perpetuity, for promotional, marketing, commercial, and archival purposes without compensation.
The Event premises may be monitored by surveillance for safety and enforcement purposes.
ARTICLE 13: MEDICAL CARE CONSENT
You consent to medical evaluation, treatment, and transportation as deemed appropriate by staff or medical professionals. You are solely responsible for all medical costs. You release the Company Parties from liability related to such medical care to the fullest extent permitted by law.
ARTICLE 14: PERSONAL PROPERTY & VEHICLES
The Company Parties are not responsible for lost, stolen, damaged, or confiscated property. Parking, if available, is at Your own risk.
ARTICLE 15: DISPUTES / JURY TRIAL WAIVER / CLASS ACTION WAIVER
YOU KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION, TO THE FULLEST EXTENT PERMITTED BY LAW.
ARTICLE 16: NOTICE & TIME LIMIT TO BRING CLAIMS
No claim may be brought unless written notice is provided to the Company within six (6) months of the incident. Any permitted legal action must be filed within one (1) year or it is permanently barred.
ARTICLE 17: GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of Ohio. Any permitted legal action shall be brought exclusively in Franklin County, Ohio, unless otherwise required by law.
ARTICLE 18: MISCELLANEOUS
This Agreement constitutes the entire agreement between You and the Company.
If any provision is held unenforceable, the remainder shall remain in full force.
Failure to enforce any provision is not a waiver.
The Company may update these Terms at any time by posting a revised version.
ACKNOWLEDGMENT
BY PURCHASING A TICKET, ACCEPTING A TICKET, ENTERING THE EVENT PREMISES, OR REMAINING AT THE EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ (OR WAIVED THE RIGHT TO READ), UNDERSTAND, AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE TICKETING TERMS & CONDITIONS.
